Raymond Kunkle, Walter Schminke and their lawyers Peters & Freedman' employed real estate "expert" Lee R. Hess to show the market value of the home a Palacio del Mar victim sold as distressed property because it was moving downhill.

Hess in his deposition stated that he valued the house in an undamaged condition. Overstating the value of this home is misleading testimony from Mr. Hess and helps Peters & Freedman make a case that the homeowner victim undersold the house.

The board collected three times the dues necessary and has spent about $300,000. of the overcollected money they stashed in the reserves to finance Peters & Freedman in this recent lawsuit against the homeowner who has been exposing their activities.

Palacio del Mar Homeowners Association board members have been for years misusing the reserves and not notificing the owners as they are required to under Civil Code 1365.5 (c)
